Terms of Service.
The following concepts will be used in these terms:
A person who logs onto the website Bungalo and utilizes the services of the site.
Bungalo ehf., kt. 540710-0230, Skólavörðustígur 11, 101 Reykjavík, owner and operator of the web: www.bungalo.is.
A tenant that rents a bungalow using Bungalo´s webpage and database.
A product listed on Bungalo website by a user for rental purposes.
A user of Bungalo.com who lists a product for commercial purposes.
1. Description of the service:
Bungalo offers an electronic booking service. The service provides a chance for owners to register their bungalows in the system on their own. The bungalow´s will then available for rent in the system´s database for tenants.
2. Registration of users, use of the web and responsibility for content.
By signing up as a user of the website Bungalo, the user agrees to respect the rules and terms of Bungalo, along with any changes that may occur in the future. The user undertakes an obligation to observe and follow these possible changes, but the terms will be accessible at any time on Bungalo´s webpage. If Bungalo executives believe that a user has somehow violated the terms or Bungalo page, then Bungalo reserves the right to block the user´s access and deny him access to services from then on.
The user is entirely responsible for all content that he posts on Bungalo´s webpage. The user realizes that Bungalo does not examine the material posted on the web in advance and the user is responsible for the content posted. The user shall register the requested information to Bungalo´s webpage and guarantees that the information is correct.
When a user logs on to Bungalo´s webpage, he must give up an active e-mail address. If the user changes his e-mail address, he must let Bungalo know about the changes. In addition, users need to update any additional personal information on the site, when updates occur.
A user´s password is not to be shared with anyone and the user is responsible for preserving the password.
A user gives Bungalo permission to e-mail him updates and news in the form of a newsletter.
3. User behavior
Users agree not to share any content that is illegal, inappropriate or pornographic, the users also agree to provide correct information through the web and update the information if necessary. Moreover, a user pledges that he will not participate in any other form of action or conduct that may have a disruptive, destructive or negative impact on the webpage and the services it offers.
In case the terms listed above are broken or debased, Bungalo reserves the right to block the user´s access and deny him access to the firm´s services from then on. Bungalo also reserves the right to delete all the content a user may have posted onto the company´s website.
4. Renting a bungalow from the webpage
4.1 Conditions for renting a bungalow:
All those who have reached 22 years of age at the time a reservation is made, may be rented a bungalow from Bungalo´s webpage.
4.2 Time of recession:
The tenant can access the Bungalow at. 16:00 on day of arrival and must return it at.12:00 on the day of departure.
4.3 Delivery of keys:
Keys are to be delivered by the bungalows owners unless otherwise noted. If the bungalow was rented through Bungalo´s webpage, the lessee is needed to provide a printed version of the booking receipt along with identifications.
4.4 Condition of the bungalow:
When delivered, the bungalow shall be clean and in accordance with the description on Bungalo´s webpage. The bungalow shall include facilities, sufficient to keep a simple home, such as furniture, kitchen and bath implements and a sleeping facility. Blankets and bedding are not supplied unless it is specifically reported by the owner.
If the tenant becomes aware of damages to the bungalow or its facilities he shall notify the owner of the bungalow within 24 hours of arrival, otherwise as soon as he becomes aware of the damages. The same applies if cleaning is inadequate and the tenant shall inform the bungalow´s owner it immediately upon arrival.
The tenant is obligated to treat the bungalow neatly and not to cause interruption to residents of nearby bungalows. Duvet´s are not to be used without duvet-covers. Smoking is not allowed. The tenant is obligated to read and follow the house-rules of each bungalow.
The tenant shall clean the bungalow after staying in it, unless other terms are agreed. Final cleaning of the bungalow shall include sweeping or swabbing the floors, wiping tables, cleaning kitchen equipment, cleaning and draining the hot tub, remove household waste and ensure that no debris is in the bungalow. If the tenant returns the bungalow without it having been cleaned, the cleaning will be done at his expense. The minimal cost of cleaning is 30,000 kr., - plus VAT.
Tenant is responsible for any damage done, during his stay and must immediately notify the owner of damage that comes up in his time of rent. If something takes place that leads to a depreciation of the bungalow´s usefulness or value, the tenant has to notify the owner immediately.
When a bungalow is booked via Bungalo´s booking system the entire payment must be made at the time of booking. The amount will be taken from the tenant´s credit card which he gives up in the booking system. The rental price of each bungalow is specified on Bungalo´s website. A confirmation is sent to the tenant via e-mail after a booking has been made in which the rental price is specified and by receiving it the tenant agrees to the price and amount of days booked.
: Cancellation must be reported to Bungalo or to the host of the property via e-mail or other verifiable means. Bungalo allows hosts to choose between three standardized cancellation policies: Flexible, Moderate and Strict.
A reservation can be cancelled with 72 hours (3 days) or more prior to the scheduled arrival date and 100% of the full rental price will be repaid.
A reservation can be cancelled with 14 days or more prior to the scheduled arrival date and 100% of the full rental price will be repaid.
A reservation can be cancelled 30 days or more prior to the scheduled arrival date and 80% of the rental price will be repaid.
4.11 Tenant information:
The tenant is responsible for giving correct information about himself, including that he has reached the age of 22 and the number of tenants each time. It is forbidden to have more persons staying in a bungalow than the maximum number given up on Bungalo´s website. If the tenant has knowingly given up incorrect information when booking, the renter is permitted to revoke the lease and expulse the tenant. The bungalows owner is permitted to call for the tenant´s credentials at any time.
4.12 Double bookings:
In cases where the renter has double booked a bungalow and is therefore not able to deliver, the tenant has the right to a full refund.
4.13. Renters default:
If the tenant believes the renter has defaulted his obligations he should point his demands at the renter. Bungalo is not responsible for the renters default.
4.14. Damage to the rented bungalow:
Claims will be filed for any damage or insufficient cleaning, see term 4.8. In case of any damage done, during the time of rent, the bungalows owner is permitted to assign Bungalo to withdraw the cost of reparation, from the tenants credit card, though never a higher amount than the cost of renting the bungalow. Bungalo is neither responsible for damage caused by the tenant during his stay nor any damage he suffers during the time of rent.
5. Intellectual property
All information, data and materials presented on Bungalo website www.bungalo.com, including but not limited to names, logos, and the layout of the website, are subject to copyright, trade mark rights, database rights and/or other intellectual property rights. You may only use those information, data and materials as strictly required for your permitted personal, non-commercial purposes. Any other use of the information, data, materials, without Bungalo prior written consent, is prohibited and will constitute a breach of these Terms and Conditions and may infringe Bungalo intellectual property rights. In the event of such a breach, we reserve our right to apply all applicable legal action and proceedings without further notice
6. Confirmation of terms
Confirmation of this Aggreement and terms is in accordance with paragraphs 1 and 2. Article 10. Act. 30/2002. By accepting the these terms, the tenant confirms that he has read them and agrees to them. The tenant will be sent an electronic confirmation of the booking in which information on where to find the terms is included. In accordance with paragraph 1. of Article 9. Act. 30/2002 Bungalo as a service provider points out that the company retains a copy of these terms. The terms are accessible in the user´s personal space on Bungalo´s website. Bungalo works in accordance with the ethical code of the Icelandic Federation of Trade and Services, on electronic transactions which is accessible on the Federation´s webpage.
7. Court cases
Legal issues that may arise due to these conditions, or the communication of a tenant and Bungalo shall be brought before the District Court.
